The 6-point compliance checklist

If a Department of Employment and Labour inspector walked in today, would you pass?

  • Check that every employee earns at least R30.23 per hour (or the applicable sectoral determination).
  • All overtime is paid at 1.5x (weekdays) or 2x (Sundays & public holidays), with written agreements in place.
  • Annual leave of 21 consecutive days is provided. Leave records are kept for at least 3 years.
  • Sick leave of 30 days per 36-month cycle is tracked. Medical certificates are obtained for absences over 2 days.
  • Employment contracts are in writing and include all BCEA-mandated particulars (Section 29).
  • Retrenchment procedures follow BCEA Section 41 and severance pay of at least 1 week per year of service is budgeted.
